  • The distinction between traditional retributive justice is the approach to the subject: Retributive justice asks three questions: (1) was a law broken? (2) Who did it? (3) What punishment is appropriate. Restorative justice asks (1) Was there a harm to someone? (2) Who is accountable for the harm, and (3) what needs to be done to restore the person harmed to the position they were before the harm, or what other means should be employed to render justice?
    Two areas of injustice currently on the law books are the outdated criminal sexual conduct and sex registration laws, and the driver responsibility fee. These are examples of retributive justice.
